JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-01-2018 This case has been heard out of turn as it was submitted by the learned counsel for the petitioner that the grandmother of the petitioner has died on 20.11.2017. In support of the aforesaid contention, a certificate issued by the Mukhiya of Gram Panchayat Raj Khairwar has been shown to this Court which has been kept on record.
Heard the learned counsels for the petitioner and the State.
The petitioner seeks bail in connection with Rivilganj P.S. Case No. 93 of 2017 dated 26.03.2017 instituted for the offence under Sections 366(A) and 34 of the Indian Penal Code. The father of the victim girl has alleged in the subject FIR that his daughter had gone to the examination centre but did

Later, it transpired that with the help of the petitioner and Ashok Sharma one of the other co-accused persons of this case, the victim was taken to an unknown place for the purposes of marrying her with aforesaid Ashok Sharma. In the statement of the daughter of the informant recorded under Section 164 Cr. P.C., though the petitioner has been named but nothing specific has been alleged against him. A development in this case took place and Ashok Sharma, the co-accused referred to above, married the daughter of the informant and he has been living with the victim as married couple for a long time.
Learned counsel for the petitioner has drawn the attention of this Court to the affidavit sworn by the daughter of the informant stating that she has married Ashok Sharma of her own volition.
Taking into account the aforesaid facts, Ashok Sharma was granted anticipatory bail by a coordinate Bench of this Court vide order dated 08.11.2017 passed in Cr. Misc. No. 34998 of 2017.
The petitioner is said to be in custody since 18.08.2017.
In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail
Patna High Court Cr.Misc. No.57774 of 2017 (3) dt.03-01-2018 bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Chapara in connection with Rivilganj P.S. Case No. 93 of 2017.
