====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-10-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 323, 341, 307, 379, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, on 28.5.2024 at about 7.30 pm when the informant was in the market, accused persons demanded rangadari from the informant. Same day at 8.30 pm all the FIR named accused persons including these petitioners

Patna High Court CR. MISC. No.67991 of 2024(2) dt.23-10-2024 2/3 entered the house of the informant, damaged articles and assaulted her family members. Petitioner no.4 hit with iron rod on the head of informant's son, whereas petitioner no.2 hit with danda to one Bhushan Paswan. Accused persons also assaulted the informant with bricks, legs and fists.

It is submitted on behalf of the petitioners that the instant case is counter blast of Cheriya Bariyarpur Police Station Case No. 102 of 2024 lodged by the petitioner's side against the informant side. Moreover, on the trivial issue scuffle took place between the parties in which both sides sustained injuries. Injuries caused by these petitioners have been found to be simple in nature. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Manjhaul, Begusarai in Cheriya Bariyarpur Police Station Case No. 103 of 2024, subject to the conditions
