JUSTICE BIRENDRA KUMAR ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 420,467,468,471,406 of the Indian Penal Code.

Allegation against the petitioner is that the loan of Rs. One Crore was sanctioned in favour of the petitioner. The petitioner had produced a document showing that the rice mill was running on the same land rather the fact was that the rice mill was not running on the said land.

Submission of the learned counsel for the petitioner is that the petitioner has stated on oath in paragraphs-5

Patna High Court Cr.Misc. No.58265 of 2017 (3) dt.10-01-2018 and 6 of the bail petition that he was a staff of Viswajeet Anand and in fact Viswajeet Anand had taken the loan by inducing the petitioner to produce his title deed. Subsequently, Viswajeet Anand committed suicide. The bank cannot show any paper to substantiate that in fact loan was sanctioned in the name of the petitioner. Petitioner is in custody since 18.08.2017. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sasaram (T) Police Station Case No.436 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
