JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Rupouli (Mohanpur) P. S. Case No. 25 of 2019, disclosing offences under Sections 341, 323, 307, 379, 504, 506 & 34 of the Indian Penal Code.

As per prosecution case while the informant was constructing the road, the petitioner and other accused persons came and assaulted. There is specific allegation against the petitioner no.1 of order giver and petitioner no.2 is of assault by rod.

Submission of the learned counsel for the petitioners is that as a matter of fact, there was some altercation with respect to construction of road in front of the house of petitioner no.1, due to that they have falsely been implicated in this case.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Rupouli (Mohanpur) P. S. Case No. 25 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
