JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend their arrest in connection with Bakhtiarpur P.S. Case No. 264 of 2014 registered under Sections 341,342,323,327,332,333,307,353,504,506/34 of the Indian Penal Code.

The allegation against the petitioners is that they along with other accused persons came in the office of Executive officer, Nagar Panchayt and disturbed the informant in discharging the Government duty.

Learned counsel for the petitioners submits that accusation is against the mob and a statement has been made in paragraph 3 of the petition that the petitioners have no criminal

Patna High Court Cr.Misc. No.49878 of 2016 (3) dt.09-02-2017 antecedent. Moreover, similarly situated co-accused Reetesh Ranjan and others have been granted bail in Cr. Misc. No. 33136 of 2015.

Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case no. 264 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
