The petitioner has filed the instant application for modification of the order dated 29.06.2022 passed in Cr. Misc. No. 17710 of 2021, whereby petitioner was directed to deposit 50% of Rs. 23,00,000/- i.e. Rs. 11,50,000/- to the District Cooperative Office, Aurangabad before filing bail bonds and rest amount of Rs. 11,50,000/- he was directed to deposit within a period of two months".

It is submitted by learned counsel for the petitioner that petitioner has already deposited first installment I.e. 50% to the District Cooperative Office, Aurangabad and so far as

Patna High Court CR. MISC. No.73219 of 2022(2) dt.01-02-2023 2/2 second installment i.e. 50 % is concerned, he could not deposit within time due to his illness and the same is yet to be deposited.

Learned counsel for the petitioner further submits that time of further six weeks be granted to the petitioner for depositing 50% as second installment amounting to Rs. 11,50,000/-.

In view of the above submission and considering the facts and circumstances of the case, petitioner is directed to deposit 50% as second installment amounting to Rs. 11,50,000/- within a period of further six weeks.

The order dated 29.06.2022 passed in Cr. Misc. No. 17710 of 2021 is modified to the extent that petitioner will deposit 50% as second installment amounting to Rs. 11,50,000/- within a period of further six weeks from today. The remaining part of the order shall remain unchanged.
