The petitioners apprehend their arrest in Manihari P.S. Case No. 141/2016, registered for the offences punishable under Section 436 and other sections of the Indian Penal Code and Section 27 of the Arms Act.

The informant Sugli Devi named 24 persons including the five petitioners and alleged that Lalan Yadav petitioner no. 4 put her down on the ground and torn her undergarments. She further alleged that Laxman Yadav petitioner no. 2 snatched silver chain from her neck and Sukul Yadav

Patna High Court Cr.Misc. No.49537 of 2016 (3) dt.23-03-2017 2/2 petitioner no. 3 set her house ablaze.

Learned counsel for the petitioners submits that there is counter version being Manihari P.S. Case No. 140/2016. No injury was found on the person of the informant. On account of land dispute, there is case and counter case. The Investigating Officer mentioned the place of occurrence in para 12 of the case diary, but no remnants of burning was found on the place of occurrence.

Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Katihar in connection with Manihari P.S. Case No. 141/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
