JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Dinara PS Case No. 93 of 2017 registered under Sections 307/34, 302 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that six persons were aiming at the post kept on the head of the dancing girl and one of the shot hit her causing death.

Learned Counsel for the petitioner submits that there is general and omnibus allegation against all the six, it is not specific whose shot proved fatal. Moreover the informant is also stranger to the petitioner as she too is a dancing girl, not of the same place and no arm has been recovered from the petitioner. Petitioner is in custody since 22.8.2017 and has got clean antecedent. Having considered the said facts and circumstances, the petitioner, namely, Fagu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, lst Class, Bikramganj, Rohtas in connection with Dinara PS Case No. 93 of 2017 with the condition that one of the bailors

Patna High Court Cr.Misc. No.57042 of 2017 (3) dt.16-01-2018 shall be a close family member of the petitioner. The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of medical emergency his bail bonds shall be liable to be cancelled.
