The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420, 406, 409 and 120B of the Indian Penal Code. The prosecution case is that one Fudani Devi, Ward Member of Ward No. 12 in conspiracy with the petitioner being Post-master and others withdrew Rs.2,67,980/- with regard to a Govt. scheme.

It is submitted by learned counsel for the petitioner that the withdrawal was made by Fudani Devi, who has been granted anticipatory bail vide Cr. Misc. No. 12924 of 2015 on the ground that she has deposited the entire withdrawn

Patna High Court Cr.Misc. No.41033 of 2015 (2) dt.06-10-2015 2/2 amount.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 210 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
