JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Bakhtiarpur P. S. Case No. 644 of 2018, disclosing offences under Sections 341, 323, 307, 354, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R. there is allegation of assault against petitioner and other accused persons to enter inside the house of the informant and there is allegation against co-accused Ravi Yadav to thrash her on the earth and allegation against the petitioner is of assault to the Gotini of the informant. Submission of the learned counsel for the petitioner is that the injuries are superficial in nature, which will appear from Annexure 3, whereas the Ravi Kumar @ Ravi Yadav has been granted privilege of anticipatory bail by this Court, vide order dated 23.08.2019 passed in Criminal Misc. No. 52649 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learnedA.C.J.M., Barh, District Patna, in connection with Bakhtiarpur P. S. Case No. 644 of 2018,, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
