2. The petitioner is in custody in connection with Saraiya P.S. Case No. 29 of 2023 for the offence under Sections 363, 366A, 34 of the Indian Penal Code and later on Section 376 of the I.P.C and Section 4/6 of the POCSO Act has been added.
3. It is alleged that petitioner along with other accused kidnapped the victim girl and committed rape upon her.
4. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.05.2023. He further submits that petitioner has falsely been implicated in this case as he is the cousin of the accused, namely, Bhanu Rai @ Kuldeep Rai who was in relationship with the victim girl.
5. During investigation it has come that the victim girl
Patna High Court CR. MISC. No.67978 of 2023(2) dt.18-10-2023 2/2 was in relationship with one accused Bhanu Rai @ Kuldeep Rai and she had eloped with him.
6. Considering the aforesaid facts and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Addl. District & Sessions Judge-VII, Muzaffarpur in connection with Saraiya P.S. Case No. 29 of 2023. (Sandeep Kumar, J) Harsh/ U T
