The petitioner seeks bail in Mehsi P.S. Case no. 11/2009, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

From the death of Ramakant Paswan U.D. Case no. 04/2008 was registered but after four months of the occurrence. The complainant lodged complaint case on the basis of which the present FIR was lodged. The police after investigation submitted final form finding the case false, but later on cognizance was taken. There is no eye-witness of the occurrence. Except suspicion on the ground that the petitioner had illicit relation with Poonam Devi, wife of the deceased, the police did not collect any tangible

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar-IV, Judicial Magistrate 1st Class, East Champaran at Motihari, in connection with Mehsi P.S. Case no. 11 of 2009.
