ANJANA MISHRA ORAL ORDER 19-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners have been in custody since 12.09.2017 in connection with Kotwali P.S. Case No. 450/2017 registered for the offences punishable under Sections 417/418/419/420/120B of the Indian Penal Code. Learned counsel for the petitioners submits that though he is not named in the First Information Report, his name has surfaced in the confessional statement made before the police by a co-accused which has no evidentiary value. Learned counsel for the petitioner further submits that there is an allegation that he

Patna High Court Cr.Misc. No.60919 of 2017 (3) dt.19-01-2018 2/2 had taken money for publication of result. However, there is nothing on record to show that the money transaction had taken place or that money had been given to the petitioner. It is further submitted that one Indradeo Prasad with a similar allegation against him has been extended the privilege of regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 55306 of 2017 vide order dated 04.12.2017.

Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 450/2017.
