2. The petitioner has preferred this application for grant of regular bail in connection with Ganga Bridge P.S. Case No. 66 of 2023 registered for the offences punishable u/s 323, 341, 354B, 504 read with Section 34 of the I.P.C. and Section 3⁄4 of the POCSO Act.

3. As per the prosecution case, the petitioner and three others co-accused persons are alleged to have outraged the modesty of the victim and also alleged to have assaulted the

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case and from perusal of the F.I.R., it is evident that there is a general and omnibus allegation against the petitioner. It is further submitted that no specific overt act of assault has been attributed to the petitioner. It is lastly submitted that the petitioner has clean antecedent and is in custody since 19.02.2024.

5. Learned APP for the state and learned counsel for the informant have vehemently opposed the prayer for bail and have stated that the matter has been compromised between the parties

Considering the aforesaid submissions of the parties and taking into account the orders passed by a coordinate Bench of this Court which has been brought on record by way of Annexure- 3 whereby similarly situated co-accused persons have already been granted bail, let the petitioner abovenamed, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali, in connection with Ganga Bridge P.S. Case No. 66 of 2023.
