The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 353, 323, 307, 333, 506 of the Indian Penal Code and Section 25(1B)a/26/27/35 of Arms Act.

It is a case of opening fire in air, for making havoc. There is recovery of one country made pistol and mobile from the possession of the petitioner.

No.64560 of 2022(2) dt.24-02-2023 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is no independent witness of the alleged occurrence. Moreover, the petitioner is languishing in judicial custody since 26.07.2022. similarly situated co-accused person has been granted Bail vide order dated 09.02.2023, passed in Cr. Misc. No. 57744 of 2022 by the coordinate Bench of this Court. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Dhansoi P.S. Case No. 109 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction
