2. The petitioner is in custody in a case registered for the offence punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per allegation in the FIR, total 102 liters of Nepali made liquor was recovered.

4. Learned counsel for the petitioners submits that petitioner has falsely been implicated in this case. He next submits that similarly situated co-accused persons have been granted bail by this Court passed in Cr. Misc. no. 37173 of 2024, he has no concern with the seized liquor and he is in

Patna High Court CR. MISC. No.68586 of 2024(2) dt.18-01-2025 2/2 custody since 02.09.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid facts and circumstances of this case as also the fact that similarly situated co-accused has been granted regular bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Jhanjharpur, District- Madhubani in connection with Laukaha P.S. Case No. 55 of 2024 (G.R. No.136 of 2024). (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
