====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Munger Mufassil P.S. Case No. 153 of 2024 dated 28.04.2024 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 326, 307, 504,387 of the I.P.C. and Section 27 of the Arms Act.

3. As per the prosecution case, when the informant's nephew was going to the school, the accused persons stopped him, abused and assaulted him and demanded Rs. 50,000/- as extortion. Later on 27.04.2024, the petitioner alongwith the other co-accused persons armed with pistol and rifle, fired on the nephew and cousin of the informant, due to which, they got injured.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that there is general and omnibus allegation against the petitioner. There is no specific allegation or any overt act alleged against the petitioner. There is a case and counter case between the parties. Both parties are covillagers and there is an admitted family dispute between the parties. It is submitted that the other co-accused persons, namely, Robin Rai, Pintu Rai in Cr. Misc. No. 65753 of 2024 vide order dated 23.09.2024 and the co-accused person, namely, Sunil Rai in Cr. Misc. No. 41223 of 2025 vide order dated 09.07.2025 have already been granted bail by another Coordinate Benches of this Court, annexed as Annexure-3 series to the present bail application. The petitioner has four criminal antecedents and out of which in three cases, he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 11.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond

No.66967 of 2025(2) dt.13-10-2025 3/3 of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Munger in connection with Munger Mufassil P.S. Case No. 153 of 2024 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
