The application is for grant of bail for the offence under Sections 409/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the present case has been lodged due to the fact that there was a direction from the DDC, Madhubnai, however the matter was enquired by the B.D.O., Madhepur and other officials of the Block and they found that the petitioner has completed the work, which will appear from Annexure-3 and 4 of the petition. As such there is no case against the petitioner.

Heard learned A.P.P.also.

Having heard both sides. In view of the assertion of the petitioner, let the petitioner surrender before the court below and

Patna High Court Cr.Misc. No.52121 of 2016 (2) dt.22-12-2016 the court below will release the petitioner on provisional bail of Rs.10,000/- with two sureties of the like amount to his satisfaction and in the meantime, he will enquire about the genuineness of Anneuxre-3 and 4 of the application. Once he got satisfied with the genuineness of Annexure 3 and 4, he will confirm the bail bond of the petitioner, otherwise learned court below is free to cancel the bail bond of the petitioner.

With the aforesaid observation, this application is disposed of.
