2. The petitioner seeks bail in connection with Sugauli P.S. Case No. 37 of 2024 (S.T. No. 843 of 2024) instituted for the offences under Sections 420, 379, 411, 413, 120B of the Indian Penal Code.
3. As per prosecution case, unknown persons are alleged to have stolen the pickup van of the informant.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case on the basis of the
Patna High Court CR. MISC. No.65727 of 2025(2) dt.11-09-2025 2/3 confessional statement of the co-accused Shivam Kumar and nothing else. No incriminating article has been recovered from the conscious possession of the petitioner. Learned counsel further submitted that petitioner has got no concern with the vehicle in question. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.06.2024 and has four criminal antecedents. The co-accused person has already been granted bail by coordinate Bench of this Court vide order dated 19.02.2025 passed in Cr. Misc. No. 9266 of 2025. Co-accused have also been granted bail by this Court vide orders dated 02.04.2025 and 22.04.2025 passed in Cr. Misc. Nos. 18377 of 2025 and 24692 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two
Patna High Court CR. MISC. No.65727 of 2025(2) dt.11-09-2025 3/3 sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sugauli P.S. Case No. 37 of 2024 (S.T. No. 843 of 2024).
