The petitioner apprehends his arrest in Dumra P.S. Case No. 61/2016, registered for the offences punishable under Sections 476, 336, 418 of the Indian Penal Code and Sections 18(c), 27(b)(ii), 18(A), 18(B), 28 and 36 of Drugs and Cosmetic Act.

The informant alleged that the eastern part of the premises of Asha Seva Sadan was raided and a medicine shop was found running. Dr. Rajiv Kumar Singh, B.A.M.S. (B.U.) was found practising. He disclosed that Krishna Kumar, the petitioner, was running the medicine shop.

Learned counsel for the petitioner submits that neither the petitioner nor any family member of the petitioner was

Rajiv Kumar, who was running the clinic has already been granted anticipatory bail vide order dated 05.07.2016 passed in Cr. Misc. No. 16840/2016. There is nothing on record to show that the petitioner was running the medicine shop.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 61/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
