2. The petitioner is in custody in connection with POCSO Case No. 58 of 2023 arising out of Deep Nagar P.S. Case No. 185 of 2023 for the offence under Sections 341, 376, 511 of the Indian Penal Code and Section 8/12 of the POCSO Act, 2012 and Section 3(i)(r)(s)(w)/(3)(ii)(v) of the SC/ST Act.

3. It is alleged that petitioner caught the informant's daughter with an intention to commit rape upon her.

4. Learned counsel for the petitioner submits that due to earlier case filed by the petitioner against the informant, the present case has been filed against the petitioner. In the present case, charge-sheet has been submitted by the police under Section 354(b) of the Indian Penal Code and POCSO Act. He

Patna High Court CR. MISC. No.67336 of 2023(2) dt.17-10-2023 2/2 further submits that the petitioner has got no criminal antecedent and he is in custody since 27.04.2023.

Considering the fact that the petitioner has got no criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail with a condition that he will cooperate in the trial on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions JudgeVI-cum-Special Judge, POCSO, Biharsharif, Nalanda in connection with POCSO Case No. 58 of 2023 arising out of Deep Nagar P.S. Case No. 185 of 2023.
