Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Mohania P.S. Case No. 582 of 2023 registered for the offences under Section 30(a) of the Bihar Prohibition and Excise Act. 3.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case due to village politics. Further submission is that the petitioner is neither the owner nor the driver of the alleged vehicle as contained at Annexure-P(2). It is also submitted that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the

Patna High Court CR. MISC. No.67150 of 2023(2) dt.18-10-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Special Judge-I-cum-A.J.-IV, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 582 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
