2. The petitioner seeks bail in connection with R.S. P.S. Case No. 103 of 2024 registered for the offence under Sections 21/22/23 of the NDPS Act.

3. As per the prosecution case, 56 bottles of Eskuf Cough Syrup of Codeine each bottle contains 100 ml. totalling 5.600 litres was recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. The petitioner is in jail since 29.07.2024.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for

Patna High Court CR. MISC. No.69374 of 2024(2) dt.03-10-2024 2/2 bail.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, N.D.P.S. Act, Araria in connection with R.S. P.S. Case No. 103 of 2024. (Sandeep Kumar, J) Saif/- U T
