JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and section 47(a) of the Excise Act. The prosecution case is that on information that the petitioner was selling illicit liquor, raid was laid when the petitioner escaped from the scene but twenty liters of illicit liquor was recovered from the orchard.

It is submitted by the learned counsel for the petitioner that the petitioner is a widow and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Admittedly, even assuming the accusation no case under Sections 272 and 273 of the Indian Penal Code and section

Patna High Court Cr.Misc. No.51107 of 2015 (2) dt.10-11-2015 2/2 47(a) of the Excise Act is made out. It is further submitted that recovery has not been made from the petitioner. Considering the fact that the petitioner is a lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Wazirganj P.S. Case No.335 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
