JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 91 of 2017 arising out of Danapur P.S.Case No. 408 of 2017 registered under Sections 20 and 22 of the N.D.P.S.Act.
Allegation in brief is that petitioner was apprehended carrying away 01 kg 200 gm Ganja in a polythene bag. Submission is that seized Ganja is of small quantity and petitioner is in custody since 30.06.2017 and proper procedure has not been followed for seizing the material and the police has submitted charge sheet in this case.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Rishikesh Pandey @ Ganpat is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with
Patna High Court Cr.Misc. No.57417 of 2017 (4) dt.18-01-2018 2/2 two sureties of the like amount each to the satisfaction of the learned Additional District and Sessons Judge-III at Patna in connection with Special Case No. 91 of 2017 arising out of Danapur P.S.Case No. 408 of 2017 with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
