JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State. The petitioners seek pre-arrest bail in connection with Town P.S. Case No.390 of 2010 registered under Sections 420, 406, 384, 504 and 509/34 of the Indian Penal Code. It is contended that petitioner no.1 is engaged in the business of coal whereas petitioner no.2 is engaged in the business of cement and sand and petitioner no.3 is Munshi in the registry
Patna High Court Cr.Misc. No.50575 of 2015 (2) dt.05-11-2015 2/2 office. The petitioner no.4 runs a hotel which is situated in the house of petitioner no.4 whereas petitioner no.5 is a retired personnel of Border Security Force. They are not concerned in any manner either co-accused Rina Agrawal or Ruchir agrawal. The informant under apprehension that co-accused Rina Agrawal would sell the land to the petitioners on high price has implicated them in the present case. It is further contended that the main accused Rina Agrawal has already been granted anticipatory bail by this Court in Cr. Misc. No.49537 of 2015.
Taking into consideration the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. Case No.390 of 2010 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
