JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 30-10-2018 In the facts and circumstances pleaded before this Court, the only relief which may be granted to the petitioner at this stage is to direct the S.D.M., Pupri to dispose off the application dated 14.11.2016 which is said to have been filed by the petitioner for rehearing of the Case No.M32/09. Learned counsel for the petitioner submits that despite all efforts made by him, the application preferred by him is not being disposed off. Learned counsel for the State is present and submits that in the nature of the relief prayed for in the present application, appropriate direction may be issued.

No.60911 of 2017 (4) dt.30-10-2018 2/2 In the given facts and circumstances, without entering into the merit of the contentions, at this stage, the S.D.M., Pupri is directed to dispose off the petition dated 14.11.2016 filed by the petitioner on its own merit within 90 days from the date of receipt/production of a copy of this order. Needless to say, that the application shall be considered and disposed off within the aforesaid period after hearing all the parties of the case. The application stands disposed off, accordingly.
