JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case is that informant parked his motorcycle in front of Kahalgaon railway canteen and went to see his relative. When the informant returned, he found his motorcycle missing. The First Information Report was registered against unknown. Subsequently the informant has suggested that petitioner being parking agent was paid Rs. 5/- as parking charge. Hence, he is responsible for the missing of his motorcycle.

It is submitted by learned counsel for the petitioner that in the First Information Report, it is specific that motorcycle was not parked in the parking lot but in front of the railway canteen. Moreover for the occurrence of 26.06.2015

Patna High Court Cr.Misc. No.49639 of 2015 (2) dt.05-11-2015 2/2 the First Information Report was registered on 08.07.2015. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bhagalpur in connection with G.R.P Rail Bhagalpur P.S. Case No. 55 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
