JUSTICE BIRENDRA KUMAR ORAL ORDER 06-03-2017 Heard Mr. Dudh Nath Singh, learned Counsel, appearing on behalf of the petitioner, and Mr. Asit Kumar Jha, Assistant Counsel to learned Government Pleader No.2, appearing on behalf of the State-respondents.

2. This writ application is for a direction to the respondent authorities to complete the investigation of Patliputra P.S. Case No.196 of 2012, corresponding to G.R. No.4334 of 2012, registered under Sections 341/323/498A/34 of the Indian Penal Code, on the report of Archana Kumari

Patna High Court Cr. WJC No.1112 of 2015 (3) dt.06-03-2017 2/3 Verma, daughter of the petitioner. Archana Kumari Verma was allegedly killed for dowry on 08.04.2013. No separate F.I.R. was lodged for dowry death. However, contention is that in this case itself a petition was handed over to the Investigating Officer to investigate the case in the light of allegation of dowry death also.

3. The State authorities have filed counter affidavit that investigation of this case is complete and charge sheet No.238 of 2015 dated 30.11.2015 has already been submitted in this case.

4. In the circumstances, the writ application is infructuous so far aforesaid prayer is concerned.

5. Another prayer is for direction to the Deputy Inspector General, I.T.B.P., Gola Road, Danapur Cantt., Patna, to produce the service book of the husband of late Archana Kumari Verma. This relief cannot be granted on the prayer of petitioner because personal information cannot be divulged to a third party. If Archana Kumari Verma or her children would have been there, they could have claimed disclosure of the service book as their personal interest is involved.

6. Since investigation of Patliputra P.S. Case No.196 of 2012 is complete now there is no reason to grant

Patna High Court Cr. WJC No.1112 of 2015 (3) dt.06-03-2017 3/3 interim relief of appropriate action against the Investigating Officer of the case.

7. In the result, this writ application has got no merit and accordingly stands dismissed.
