The petitioner seeks pre-arrest bail in connection with Akorhigola P.S. Case No. 143 of 2019 for the offences alleged under Sections 30(a) and 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling, information received about selling of liquor by Ajeet Singh (petitioner) in village Basantpur, the informant, along with other police officials, reached in village Basantpur. On seeing the police party, all started to flee away, but, was chased and one was apprehended, who disclosed his name as Jitendra Singh, while the petitioner was identified in the light of torch by the Chowkidar. On search of field 20 liters country made liquor in four plastic jars recovered.

No.62313 of 2019(2) dt.15-10-2019 2/2 The submission of the learned counsel for the petitioner is that the petitioner was not apprehended on spot rather he is said to be identified in the light of torch by the Chowkidar, who was present with the informant. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Akorhigola P.S. Case No. 143 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge II-cumSpecial Judge, Excise, Rohtas at Sasaram, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
