JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Daniyawan P. S. Case No. 60 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 504, 506 and 379 of IPC.

So far allegation against the petitioner as per F.I.R. is that he assaulted repeatedly on the informant, causing injury to him.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. There is no motive for the petitioner to assault the informant. In spite of the fact that learned Additional Sessions Judge called for the injury report, but the same has not been produced.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there are several injuries

Patna High Court CR. MISC. No.59414 of 2019(2) dt.19-09-2019 2/2 on the person of informant on his nose, ear and head. Having heard both sides, considering the nature of allegation of repeated assault, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
