ANJANA MISHRA ORAL ORDER 27-11-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kadirganj P.S. Case No.100 of 2014 for allegedly having committed the offence under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that general and omnibus allegation has been made against the present petitioner, who is an old man and even taking into consideration the entire allegation made in the F.I.R., the petitioner has no role to play.

Considering the nature of allegations made against the petitioner and that he has clean antecedents, let the

Case No.100 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
