====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-11-2023 Heard learned counsel for the petitioners, learned counsel for the North Bihar Power Distribution Company Ltd. and learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 341, 323, 353, 504, 506 of the Indian Penal Code.
3. Allegation against the petitioners is that they along with other accused persons assaulted the informant, who is a government employee.
4. Learned counsel for the petitioners submits that the petitioners is innocent and have been falsely implicated in this case. He submits that there is no specific overt act against

He submits that there is no eye witness to the occurrence and due to suspicion, petitioners have been made accused in this case. He submits that no person was injured in the occurrence. He further submits that petitioner no. 1 has no criminal antecedent and petitioner no. 2 has one criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State and learned counsel for the North Bihar Power Distribution Company Ltd. oppose the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 411 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
