ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as well as learned counsel for the informant.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Viscera report which was called for has also been received. Learned counsel for the petitioners submits that it is a case of suicide. However, on perusal of the First Information Report, it appears that the informant has lodged the case purely on suspicion. The entire family members including the wife of the deceased, father-in-law, mother-in-law and brother-in-law have been made
Patna High Court Cr.Misc. No.52445 of 2015 (5) dt.05-08-2016 P2/2 accused in the present case. Post-mortem report also does not show any external or internal injury.
Considering the nature of allegations made and that there is no connecting material to show that it was because of these petitioners that the boy (son-in-law) had committed suicide, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha (Mission O.P.) P.S. Case No. 176/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
