1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 76, 352 and 351(2) of the BNS, 2023.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 3 is a woman and the informant alleges that accused persons

No.64200 of 2025(2) dt.24-09-2025 2/3 including the petitioners came to his house and assaulted his son and wife, on pretext that they stole mobile, further Kamaldeo assaulted Manjeet by lathi causing injury on head while Naman dashed his wife on the ground and Puja snatched chain.

4. Learned counsel for the petitioners submits that initially when the case was instituted, it was instituted for offences which carried punishment of seven years and less, but then police during the course of investigation added Section 109 of the BNS, 2023 without their being any corroborating material to attract the said section. It is also submitted that the date of occurrence is 25.06.2025 and the FIR came to be instituted on 04.07.2025 without any plausible explanation for delay.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Amour

Patna High Court CR. MISC. No.64200 of 2025(2) dt.24-09-2025 3/3 P.S. Case No. 288 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.

7. Accordingly, the instant anticipatory bail application is allowed.
