====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 366(A), 379, 504 and 506/34 of the IPC.

The prosecution story, in brief, is that on 18.05.2019 the daughter of the informant, Roji Kumari, aged 15 years, has been kidnapped by Ankush Kumar Roy (petitioner), Ramchandra Rai and wife of Ramchandra Rai for the purpose of marriage. He also taken away money and ornaments of the informant. When he enquired from Ramchandra Rai father of the petitioner then he and his family members misbehaved with him.

The petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The victim has been examined under Section 164 Cr. P.C. She has not supported the allegation made in the F.I.R. She has left her house out of her own will and got married. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Naugachia, in connection with Dholbajja (Kadwa) P. S. Case No. 35/2019.
