The petitioner apprehends his arrest in Warishnagar P.S. Case No.187 of 2016 registered under Sections 341, 323, 354, 427, 504/34 of the Indian Penal Code.
The informant alleged that she along with her family members went to the shop of the petitioner for taking foodgrains. The petitioner took ration card of her and her family members but did not give foodgrains. The petitioner is also alleged to have misbehaved with the informant.
The learned counsel for the petitioner submits that all the allegations are false and concocted. No occurrence ever took place as alleged by the informant. The police after investigation submitted final form finding the case false.
Patna High Court Cr.Misc. No.57157 of 2017 (2) dt.18-12-2017 Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warishnagar P.S. Case No.187 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
