JUSTICE BIRENDRA KUMAR ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 399/402/414/120B of the Indian Penal Code, Sections 25(1-A)/25(1-AA)/25(1-b)A/26(ii)/35 of the Arms Act and Section 20/22 of the N.D.P.S. Act. The petitioner and others were apprehended on suspicion that they were preparing to commit dacoity. The narcotic items were recovered from other co-accused. Submission of the petitioner is that only one mobile has been recovered from the possession of the petitioner and petitioner has got no criminal antecedent. He is in custody since 29.10.2016.

Case No. 200 of 2016.
