1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Bochahan P.S. Case no.64 of 2024 registered under sections 147, 148, 149, 341, 323, 307, 353, 504 and 506 of the Indian Penal Code.
3. The allegations in the F.I.R is that all accused persons including this petitioner herein attacked upon the police officials.
4. Learned counsel for the petitioner submits that it would be evident from the F.I.R itself that there is general and omnibus allegation imputed against him. No specific overt act has been attributed to the petitioner. Learned counsel for the
Patna High Court CR. MISC. No.66067 of 2025(2) dt.19-09-2025 2/3 petitioner in reference to order granting anticipatory bail to coaccused Akshay Kumar vide order dated 22.05.2025 passed in Cr. Misc. No. 33623 of 2025 by a co-ordinate Bench of this Court submits that injury report of the informant also shows that the injury is simple in nature. The petitioner undertakes to cooperate in case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Taking into consideration the fact that there is no specific allegation of assault upon this petitioner and also considering that similarly situated co-accused has already been granted anticipatory bail by the aforesaid order dated 22.05.2025, it is directed that the petitioner, above named, having no criminal antecedent in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bochahan P.S. Case no.64 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023 and
