Petitioner seeks bail in a case registered under section 414 of the Indian Penal Code.

Petitioner and co- accused Chhotelal Chaudhary were caught with seized motorcycle and admittedly, Chhotelal Chaudhary has already been granted the privilege of bail whereas the petitioner is in jail custody since 9.8.2016 without having any criminal antecedent. Moreover, there is nothing in the impugned order to show that seized motorcycle was stolen property.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Dighal Bank P.S.
