The petitioner seeks bail in a case registered under Sections 379/34, 411 & 414 of the Indian Penal Code. Allegedly, the a red bag of the informant containing laptop, cash and certificates, was snatched away by the miscreant in the train.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-05-2019. Charge sheet has already been submitted. The name of the petitioner transpired in this case on the basis of disclosure made by the coaccused. There is no recovery of any incriminating article from

Patna High Court CR. MISC. No.62259 of 2019(2) dt.14-10-2019 2/2 possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Rail, Bettiah, West Champaran in connection with Motihari (Bapudham) Rail P.S.
