The petitioner is apprehending arrest in a complaint case filed for the offences punishable under Sections 420, 406, 467, 468, 471, 120B of the Indian Penal Code wherein process has been directed to be issued after cognizance being taken. The prosecution case is that the complainant entered into an agreement for purchase of a particular piece of land, subsequently, the sale deed was executed on 09.09.2013 in favour of wife of the informant namely Sarita Devi but when the complainant went to get the mutation of the alleged land done he came to know that the said land was already transferred in favour of the petitioners on 09.07.2013.

Patna High Court Cr.Misc. No.53090 of 2015 (2) dt.23-11-2015 2/2 It is submitted by learned counsel for the petitioners that the thrust of accusation is against Chirai Devi. There were no signature of the petitioners on the 'kewala'. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur (Bhabhua) the in connection with Complaint Case No.1233 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
