The petitioner seeks bail in Gopalpur P.S. Case No. 85/2016, registered for the offences punishable under Sections 414, 272, 273 and 34 of the Indian Penal Code and Section 47 of the Bihar Excise Amendment Act, 2016.

The informant recorded his self-statement and alleged that he on secret information visited Ghogha Chowk and there he saw two persons coming by Splendor motorcycle bearing Registration No. BR 22U 5965. The petitioner was allegedly driving the said motorcycle and another pillion rider was carrying a gunny bag. The gunny bag was containing 90 bottles of liquor each containing 300ml, total 27 litres liquor.

No.54212 of 2016 (2) dt.21-12-2016 2/2 It has been submitted on behalf of the petitioner that coaccused Basant Mukhiya, who was allegedly driving the motorcycle has been allowed bail in Cr. Misc. No. 53121/2016. The petitioner is in custody since 10.09.2016. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 85/2016.
