2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Thakurganj P.S. Case No. 225 of 2023 registered for the offence under Section 21(b), 23(b), 29 of the NDPS Act.

3. Earlier the bail application of the petitioner has been rejected vide order dated 10.07.2024 passed in Cr. Misc. No. 47787 of 2024, which reads as under:

"Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Thakurganj P.S. Case No. 225 of 2023 giving rise to Special (NDPS) Case No. 05 of 2024 registered for the offence under Section 21(b), 23(b), 29 of the NDPS Act.

3. 102 grams of Brown Sugar has been recovered from the possession of the

Patna High Court CR. MISC. No.63790 of 2025(3) dt.10-02-2026 2/2 petitioner and he is in custody since 13.10.2023.

4. Considering the recovery of intermediate quantity, this Court is not inclined to grant bail to the petitioner for the present.

5. Accordingly, this application is dismissed.

6. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest."

4. In the trial, out of five witnesses, three witnesses have been examined.

5. Considering the gravity of the offence and the fact that the trial has started, I am not inclined to review my earlier order.

6. Accordingly, the application stands dismissed in light of the judgment of the Hon'ble Supreme Court in the case of 'X vs. State of Rajasthan & Anr.' reported in 2024 SCC Online SC 3539.
