JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Maner P.S.Case No. 123 of 2017 registered under Section 302/34 of the Indian penal Code.

Allegation in brief is that all accused persons came in Khatal of the informant and Santosh Kumar and this petitioner caught his son and Yogendra Rai assaulted with him with knife causing his death. It is alleged that motive is that accused persons have committed theft of maize from the field of the informant, therefore, this occurrence was committed.

Learned counsel for the petitioner submits that allegation of stabbing the informant's son is against Yogendra Rai, who is said to have been given one single blow and there is no assault by this petitioner and has no criminal antecedent except one case lodged

Patna High Court Cr.Misc. No.57907 of 2017 (3) dt.02-02-2018 2/2 under Section 109 Cr.P.C. and charge sheet has been submitted. Having considered the aforesaid facts and circumstances, the petitioner, namely , Lall Saheb @ Lal Saheb Rai, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-VI, Danapur, Patna in connection with Maner P.S. Case No. 123 of 2017.
