The petitioner is in custody in connection with Kutumba P.S. Case No.48 of 2014 for the offences punishable under Sections 304(B), 120(B), 201/34 of the Indian Penal Code. Learned counsel for the petitioner with reference to the F.I.R. submits that though the petitioner happens to be the husband of the deceased and the allegation is of causing her death for dowry demand but the fact is that the deceased wife of the petitioner had undergone an operation for hepatitis and which womb and the stitches of the operation did not heal properly leading to her death. Learned counsel in support of his submission has relied upon the certificates present at Annexure-2 of the main application and enclosed at Annexure-4 of the
Patna High Court Cr.Misc. No.58096 of 2015 (2) dt.29-01-2016 2/2 supplementary affidavit to submit that the wife of the petitioner had medical problems and was under treatment. It is submitted that it is only by virtue of the death taking place within one year of marriage as well as the status of the petitioner of being the husband of the deceased that he stands charged. Having heard learned counsel for the parties and perusing the documents on record, let the petitioner namely, Satrughan Paswan be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 48 of 2014.
