The petitioner apprehends his arrest in connection with Alauli P.S. Case No. 165 of 2016 registered under Sections 364, 302, 120B/34 of the I.P.C. pending in the Court of C.J.M., Khagaria.

The petitioner along with other accused persons reached at the door of the informant armed with rifle and began to fire and abuse her family members. Thereafter, on the order of petitioner, the co-accused Dharamveer Yadav shot at the left temple of her husband, who died on the spot.

Submission is that there is no material against the petitioner in the case diary. It is also submitted that the entire

Patna High Court Cr.Misc. No.54394 of 2016 (3) dt.09-02-2017 2/2 allegations are false and fabricated in this case. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that petitioner is named in the F.I.R. and petitioner has criminal antecedent.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
