JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-08-2018 This application has been filed seeking direction to the respondent Bihar Sanskrit Shiksha Board to make necessary correction in the petitioner's certificate of passing Madhyama examination held by the Board in 1981 to the extent the same relates to the date of birth.

A copy of the certificate has been brought on record by way of Annexure-1, in which the date of birth has been entered as 10.05.1967. She claims, however, that her actual date of birth is 01.01.1974 as recorded in school register. The certificate, which has been brought on record at Annexure-1, appears to have been issued by the Board on

Patna High Court CWJC No.9353 of 2018(3) dt.14-08-2018 2/2 12.07.2017. The Court being inquisitive about the fact that when the result was published in 1989, what was the reason for the Board to issue the certificate in 2017, personal appearance of the Secretary of Bihar Sanskrit Shiksha Board was directed and accordingly, he is present. He informs this Court that the certificate, at Annexure-1, is not original certificate issued by the Board, rather in response to an application filed by the petitioner for issuance of a duplicate certificate, the said duplicate certificate has been issued by the Board. This fact has been concealed in the writ application.

In any view of the matter, the Court is not inclined to entertain this writ application for correction of date of birth in the certificate after nearly 30 years of passing of the examination.

This application has no merit. It is accordingly dismissed.

Personal appearance of the Secretary of the Board stands dispensed with.
