The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

Allegation against the petitioner is to commit robbery and while committing so, taken away cash of Rs. 2200/- along with certain valuable personal documents as ATM card, registration certificate of vehicles etc. from the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case on the basis of suspicion. The petitioner is not named in FIR rather his name came into light in this case on the basis of confession made by

Patna High Court CR. MISC. No.64878 of 2022(2) dt.02-02-2023 2/2 co-accused namely, Badal Singh. Neither the petitioner has been put on TIP nor any incriminating material has been recovered from his possession which may connect this petitioner with the present set of robbery. Moreover, similarly situated co-accused namely, Amarjeet Kumar has already been granted bail by a coordinate bench of this court vide order dated 20.9.2022 in Cr. Misc. No. 39273 of 2022. It is further submitted that the petitioner is languishing in judicial custody since 17.1.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Garkha P.S. Case No. 730 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra.
