The petitioner is apprehending arrest in a case registered for the offences punishable under section 414 of the Indian Penal Code and section 47(a)(f), 13(f) and 48 of Excise Act and section 2(s),3 and 5(B) of the Bihar Excise (Mahua Flowers) Rules, 2006.

It is alleged that 65 bags of Mahua flower were recovered from the Bolero vehicle of the petitioner. It is submitted by the learned counsel for the petitioner that the Bolero vehicle was sent to Jharkhand and on return journey the driver might have loaded certain things. It is not in dispute that the petitioner was not present in the vehicle at the time of recovery. Statement has been made in paragraph 3 of the

Patna High Court Cr.Misc. No.56267 of 2015 (2) dt.11-12-2015 2/2 petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Chandauti P.S. Case No. 192 of 2015 pending in the court of learned CJM, Gaya. This application is disposed of with the aforesaid observation/direction.
